Article 1 Object

Owner of the brand MySense,
Hereinafter referred to as "Seller" or "MySenses",
And any individual with the capacity to enter into a contract, acting for the satisfaction of personal needs without intent to resell the products MySenses and want to buy through the sites and mysenses.com mysenses.fr. .
These terms represent the conditions under which MySenses, within the use of its websites, offers and provides through remote sales and through electronic sales MySenses product to a consumer.
Consumers have read the general terms and conditions before placing an order and have them accepted without reservation. These general conditions of sale can be modified and those that apply are those in effect at the time of checkout.

Article 2 Order process

If the consumer is not registered, he must create an account and give his personal information (including his address and phone number which are required). He must then click on "Register" (confirmation of account creation).


When registering, the consumer chooses access codes which are private and confidential, allowing MySenses to identify him. The consumer is solely responsible for maintaining the confidentiality of these codes and their use.

If the consumer is already registered, he must enter the connection settings (login password).


He must also accept the general conditions of sale, after reading them in full.

The consumer must choose a payment method proposed by MySenses, specified in Article 6, and follow the online instructions.

">Step 4 : Order Confirmation

A confirmation email is sent to the consumer at the address indicated by him when he signed up.

The "double click" of the consumer on the purchase order constitutes an electronic signature which has, between the parties, the same value as a handwritten signature, with the stipulation that the first click by the consumer confirms his order and by clicking a second time he definitely agrees to the order after reviewing it.

Any order signed by the buyer is firm and final.

Article 3 Proof of transaction

The records stored in the vendor computer systems under conditions of reasonable safety, will be considered proof of communications, orders and payments between the parties.
The filing of purchase orders and invoices is made on a reliable and durable back up and they can be produced as proof.

Article 4 Products

The vendor presents on its site products for sale with characteristics as accurate as possible. However, if errors or omissions were found in this product, the responsibility of MySenses can not be held in any way, text and pictures are not contractual.
The submissions made by the seller are valid only within the limits of available stocks. In case of unavailability, the seller shall inform the customer immediately, by mail, and may provide, as an option, either a credit or a refund (re-credited to the credit card payment) in the best possible time or a delayed delivery of the missing product.

Article 5 Prices

Prices are in Euros, and are available only as of the date of dispatch of the order by the consumer.
Delivery costs are additional charges and are not included in our prices, they are indicated before the validation of the order.
Prices are all added taxes including French VAT, and any discount at the time of the order. Any changes in VAT will be reflected in the prices of the online store.
If one or more taxes or contributions were to be created or modified, increased or decreased, this change will be reflected in the selling price of products on the online store. However, a price can not be changed once the order is confirmed.

Article 6 Payment

To pay for the order, the consumer has his choice of payment methods: Visa, Carte Bleue, Mastercard, American Express, PayPal.
The consumer garantees to give the necessary permissions to the vendor to use the chosen payment method during the validation of the order. The seller reserves the right to suspend any order and any delivery in case of refusal to authorize payment by credit card from the certified financial institutions.
The delivery note will be included in the package containing the product (s) ordered, the consumer has the ability to print the invoice by logging into the site in the "order tracking".
To ensure the security of payments, MySenses uses the secure payment service Mercanet BNP and Paypal. The banking data are encrypted and do not circulate unencrypted on the Internet.

Article 7 Delivery

The products are delivered to the address specified by the customer within the time specified in the order. The seller is not responsible for the longer delivery times due to the carrier, including any loss of products or force majeure.
Shipping is done either by Colissimo or Chronopost, under the conditions specified in the page "delivery" of the site. Once the shipment is made, the consumer receives an email immediately to inform and enable him to monitor the delivery any time.
It is the responsibility of the consumer to verify the number and condition of the goods at the reception, and in case of damage and / or missing product, make reservations to the carrier immediately upon delivery and inform, by mail or by email, the seller within 7 days. Any claims made beyond this period will be rejected.

Article 8 Returns

8-1 Withdrawal
Pursuant to Article L121-20 and following of the Code of consumption, the consumer has a cooling-off period of 7 days to return an item, from the date of receipt of the order of the product. Beyond this period, MySenses reserves the right to refuse any refund.

8-2 Exchange
The consumer has a period of 15 days from the date of receipt of the product to request an exchange. Beyond this period, any product delivered is considered compliant and accepted by the consumer and MySenses therefore reserves the right to refuse any exchange.
In case of withdrawal, as in case of exchange, the item must be returned in its original packaging, without being worn (except in case of exchange, subject to its perfect condition), with all labels attached to the original product:

The consumer is responsible for the return costs.
Once the package is returned and received by the seller in good and due form, there will be, in the event of cancellation, a credit card refund, excluding shipping costs. The consumer has the option to accept, in lieu of a refund, a credit note valid for one year on MySenses sites. In case of exchange, there will be exchange of the product, or a credit note valid for one year on MySenses sites.
The consumer must report all returns by email via the "contact" page of the site. Cash on delivery shipping (with payment upon arrival) are systematically denied.
The consumer must ensure sufficient postage to return the parcel, provided that all additional costs, of any nature whatsoever, due to receipt of the package will be charged to the consumer.

Article 9 Product warranty

The products sold are in compliance with the law on conformity in accordance with Articles L211-4 and following of the Code of consumption, and the legal guarantee against hidden deffects under section 1641 of the Civil Code, allowing consumers to return the defective or non-compliant product.

The guarantee given by MySenses on its product is subject to strict compliance by the consumer for use of these products such as listed on them. MySenses products can never be a substitute for the vigilance of a responsible adult, or meet the expectations or use by the consumer other than detailed in the instructions.

Article 10 Force majeure

Neither party will have failed in its contractual obligations, to the extent that the execution is delayed, hindered or prevented by a fortuitous event or force majeure (unforeseeable, irresistible, beyond the control of the parties).

Article 11 Partial non validation

If one or more provisions of these terms are held to be invalid or declared as such under any law, regulation or following a final decision of a competent jurisdiction, the remaining provisions will remain in full force and their effects.

Article 12 Protection of personal data

The seller uses only the data given in the order for the preparation and monitoring as part of customer service. All personal data about customers is stored and used by Seller only in accordance with the Data Protection Act 78-17 of 6 January 1978.

The processing of personal data collected by the sites and mysenses.fr and mysenses.com has been declared to the CNIL.

The consumer has a right to access, modify, rectify and delete data. To exercise this right, they simply send a mail to the following address:

The seller will take all necessary security measures to protect data in its possession against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons. However, the consumer is informed that the seller can not guarantee perfect security in data exchange on the Internet. The consumer is informed that MySenses may use cookies on internet.

Article 13 Intellectual property

All elements of the sites mysenses.fr and mysenses.com (text, photos, video animation ...) and the trademarks, logos and designs appearing on such sites, are the exclusive property or are licensed to the benefit of MySenses, use of this items are forbidden and may lead to prosecution.

Article 14 Responsibility

The seller agrees to make its best efforts to ensure the proper functioning of the websites it operates, subject to:

  • saturation or failure of the Internet;
  • interference of third parties in communication systems and transmissions, or malfunctions or termination of these sites due to negligence, misconduct or other acts of consumers or a third party ;
  • interruption of such sites has become necessary for the maintenance, repair or development;
  • an event of force majeure.

Article 15 Dispute resolution

These general conditions are subject to French law. This applies to substantive laws as to form. In case of dispute or claim, the consumer should first contact the seller for an amicable resolution.
